2. Information We Receive

Information you choose to submit:
Personal Data.
When you register with MindSwarms you provide us with your name, email address, phone number, gender, date of birth, and primary geographic location. You also have the option to provide certain additional information (such as your full mailing address, household income, race, or marital status) so that MindSwarms can better match you with Research Studies or allow you to participate in a wider range of studies.

Research Data.
When you apply to a Research Study, you will answer additional questions about yourself as part of the application for the Research Study. If the researcher determines that you are a good match for the study, you will be invited to participate. During the Research Study, you will record a video of yourself via webcam in response to each question.

Information we automatically collect:
Site Activity, Access, and Browser Information.
When you interact with MindSwarms, we automatically collect certain usage data to help us understand how you use MindSwarms. This information can include your IP address, browser and computer type, access time, the webpage from which you came, and the webpage(s) that you access during your visit.

GDPR Info.
mindswarms is fully compliant with GDPR. We use cookies (which are small amounts of data sent from a web server to your browser or flash player that are stored on your computer’s hard drive) and web beacons (which are invisible files located on webpages that you visit) to keep track of your use of MindSwarms, to validate your identity, to remember your password and preferences, to tailor MindSwarms to meet your personal interests, and to improve the quality and performance of MindSwarms.

3. How We Use Your Information

On Our Website.
We use the information we collect to interact with you on our website, to measure and improve the services we provide, and to provide you with customer support.

To Match You With Potential Research Studies.
We use the Personal Data you provide to us to screen you for eligibility and present you with Research Studies that you may qualify for.

To Contact You.
We may use your Personal Data to contact you in regard to Research Studies or new opportunities to participate in Research Studies. In the latter case, you have the ability to control your email notification preferences from the “Your Account” page of our website. We may occasionally use your Personal Data to contact you for marketing or referral opportunities. If you wish to opt out of receiving such messages, you may simply follow the opt-out procedure specified in such emails.

Account Auditing.
We may use your Personal Data to verify the authenticity of your account. This may involve contacting you via mail, telephone, email, or text message. By agreeing to these terms you agree to be contacted.

4. How We Share Your Information

Personal Data.
When you apply to a Research Study, we may share portions of your Personal Data with the Researcher. We may also use portions of your Personal Data to promote our services. Unless you give you explicit consent, however, we will not share your contact information or full name with Researchers or use it in our promotional materials.

Research Data.
The Research Data you provide will be shared with the Researcher. Our agreements with Researchers permit them to use the Research Data for their internal market research purposes. Please note that though our agreements with Researchers prohibit them from making the Research Data you provide publicly available, we are not responsible for the actions of the Researchers. We may also use the Research Data you provide to promote our services.

Aggregated Data.
From time to time, we may share aggregated User Information with third parties. However, we will not share any aggregated data in a manner that would enable the recipient to personally identify you.

PayPal.
We will provide your email address and payment amounts to PayPal so that we may make payments to your PayPal account. Information provided to PayPal is governed by PayPal’s privacy policies and we are not responsible for how PayPal uses this information.

Study Referrals.
When you refer a Research Study to a friend, we will send your friend an invitation on your behalf using your first name, last initial, and the email address affiliated with your MindSwarms account.

Responding to Legal Requests.
We reserve the right to share any User Information in response to subpoenas, court orders, or legal processes, or to establish, protect, or exercise our legal rights or defend against legal claims. We reserve the same rights to investigate, prevent, or take action against any illegal, unsafe or unethical activities such as fraud or abuse (e.g. creating multiple accounts).

Companies under Common Control.
We reserve the right to share any User Information with our parent company, subsidiaries, joint ventures, or other companies under common control with us.

Mergers and Acquisitions.
We reserve the right to share any User Information if we are acquired by or merged with another entity.

Service Providers.
We may employ third party companies and individuals to perform certain MindSwarms related services (e.g., hosting and maintenance services, database management and improvement of MindSwarms’ features). We may from time to time share your Personal Data with such third parties to administer or complete these tasks. These third parties only have access to your User Information as necessary to perform their functions and may not use it for any other purpose.

5. How You Can Change or Remove Information

Updating Your Profile.
You may modify or delete your Personal Data by accessing and updating your profile.

Prior Study Data.
We may retain a record of all User Information in our database for studies that you have participated in previously. This information may also be retained in third-party databases, such as researchers to whom we were authorized to disclose your User Information.

Back-Up Copies.
Please note that any Personal Data that we have copied may remain in back-up storage for some period of time after you modify or delete your Personal Data.

6. Security

How We Protect Your Information.
We have implemented reasonable measures to help protect your user information from loss, misuse, or unauthorized access or disclosure. However, no data transmission over the Internet can be guaranteed to be 100% secure. As a result, while we strive to protect your user information, we cannot guarantee its security with absolute certainty.

Security Notifications.
We will promptly notify you via email if our systems are ever compromised in a way that impacts the security, confidentiality, or integrity of your Personal Data.

Data Storage.

The continued use of MindSwarms following any such changes will indicate your acknowledgement and agreement to be bound by the terms and conditions of such changes. Your visit to and use of the MindSwarms website and service and any dispute over privacy is subject to this privacy policy and our terms of service, including limitations on damages, arbitration of disputes, and application of California law.

8. Definitions

To help you understand this privacy policy, the following capitalized terms shall have the following meanings:

“MindSwarms” means the services that we make available.

“Personal Data” means any data that describes you (such as name, gender, age, phone number, and address), your beliefs (such as political party), or your behaviors (such as shopping habits).

“Researcher” means a third party conducting research through MindSwarms.

“Research Study” means a research study offered containing text, audio and/or video questions that are answered via webcam by participants.

“Research Data” means sample videos, study applications, and the responses and other information you provide (whether through text, video or audio) for the Research Studies, and any behavioral or other data on your usage of MindSwarms collected by us.

“User Information” means Personal Data and Research Data.

“We” or “us” means MindSwarms, Inc.
